1. Agreement to Terms

By accessing or using PrinterMonitor Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance.

2. Account Terms

2.1 Account Creation

  • You must be 18 years or older to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You are responsible for all activities under your account
  • One person or organization may maintain only one free account
  • You must not use the Service for any illegal purpose

2.2 Account Security

You must:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Not share your account with others
  • Use a strong, unique password

We are not liable for any loss or damage from your failure to maintain account security.

3. Service Terms

3.1 Service Description

PrinterMonitor Pro provides printer monitoring services that collect and display metrics from SNMP-enabled printers including toner levels, page counts, and status information.

3.2 Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance (we'll notify you in advance)
  • Emergency maintenance
  • Technical issues beyond our control
  • Force majeure events

3.3 Service Modifications

We reserve the right to modify or discontinue the Service (or any part thereof) with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any laws in your jurisdiction
  • Infringe upon intellectual property rights
  • Upload malware, viruses, or malicious code
  • Attempt to gain unauthorized access to systems
  • Interfere with or disrupt the Service
  • Scrape or harvest data from the Service
  • Reverse engineer or decompile any part of the Service
  • Resell the Service without authorization
  • Use the Service to compete with us
  • Abuse trial periods by creating multiple accounts

Violation of this Acceptable Use Policy may result in immediate account termination.

5. Payment Terms

5.1 Pricing

Current pricing is available at prntr.org/#pricing. Prices are subject to change with 30 days notice for existing customers.

5.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • All fees are in U.S. Dollars unless otherwise stated
  • Payment is due upon subscription or renewal
  • We use Stripe for payment processing
  • You must provide valid payment information
  • Failed payments may result in service suspension

5.3 Refunds

We offer a 30-day money-back guarantee for first-time customers. Refund requests must be submitted within 30 days of initial purchase. Refunds are not available for:

  • Renewals or subsequent billing cycles
  • Accounts terminated for Terms violations
  • Partial month usage

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

5.5 Free Trial

New accounts receive a 14-day free trial of the Pro plan. No credit card required for trial. After trial expiration, accounts are downgraded to the Free plan unless you subscribe.

6. Intellectual Property

6.1 Our IP

The Service and all its content (excluding your data) are owned by PrinterMonitor Pro and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

6.2 Your Data

You retain all rights to the data you submit to the Service. You grant us a limited license to use your data solely to provide the Service. We will not use your data for any other purpose without your consent.

6.3 Open Source Proxy

Our proxy device software is open source under the MIT License. You are free to use, modify, and distribute it according to that license. However, the cloud service and dashboard remain proprietary.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to our data practices as described in the Privacy Policy.

Important: We collect only printer metrics (toner levels, page counts, status). We do NOT access, collect, or store any print job content or documents.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of data
  • Uninterrupted or error-free operation

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRINTERMONITOR PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data
  • Loss of business opportunity
  • Service interruptions
  • Printer malfunctions or failures

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless PrinterMonitor Pro and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your data or content

11. Termination

11.1 By You

You may terminate your account at any time through the dashboard settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent activity
  • Your payment fails (after notice)
  • We are required by law
  • We discontinue the Service

We will provide notice when possible, but immediate termination may occur for serious violations.

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute, please contact us first at support@prntr.org. We'll work in good faith to resolve it.

12.2 Governing Law

These Terms shall be governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

12.3 Arbitration

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of [Arbitration Organization]. You waive your right to a jury trial or class action.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PrinterMonitor Pro.

13.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

13.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

13.4 Assignment

You may not transfer these Terms without our consent. We may transfer these Terms to any successor.
